Children and divorce are a tragic combination. It doesn't matter how old a child is, when his or parents divorce, it's going to cause them stress. This is especially true for children coping with divorce.

How the courts treat kids and divorce:

In family courts,where divorces are processed, children and divorce arrangements are a prime consideration. Almost every part of the divorce proceedings are centered on what is best for the children. A lot of couples who go through these divorce proceedings appear to be unaware of how much of a burden a divorce can place on their kids emotions. Depending on how old the kids are, it's probably not a good idea to discuss in detail the reasons for the divorce unless you believe that they're mature enough to understand what went wrong in the parent's relationship.

Even in the most friendly of divorces, It takes a while for children to recover from the effects of a divorce. And some children never really get over social effects of divorce on children. But  how the parents act towards each other in the presence of their children has a great effect on the speed of their recovery process. That's why it's important for children and divorce proceedings for the couple to maintain a civil attitude towards each other, especially in the presence of the kids.

When going through the divorce proceedings, almost all courts have a formula that they use to how much income will be needed to provide properly for the needs of the children. If necessary, the courts will order one parent to supplement the other's income with child support to insure they are properly cared for. Violation of this order is considered contempt of court and can land the offender in jail.

Most experts, including lawyers and judges, rarely advocate that children be part of the divorce proceedings in court.. This is to protect the emotions of young children from the divorce court processes. Their recommendations are based on the fact that while the divorce will have a huge impact on the lives of the children, the divorce proceedings are basically between the couple going through the process.

Custody procedures are normally one of the more challenging aspects of divorce cases and many times the courts will try to give the husband and wife time to work it out on their own. If, however, the couple cannot make an agreement before proceedings begin, the court will consider what is best for the children and divorce courts will make the final determination, regardless of what the parents may wish.

Each states has their own rules regarding the age at which children can make their own decision as to which parent they want to live. If the children want a custodial change, but don't want to wait until they reach that age, their only option is to talk with their parents, and ask them to file a change of custody request with the court. The judge will consider the wishes of the children and divorce court officials will make the final determination.
